People weren’t even paying attention, and why should they?
You bought your land fair and square, maybe even used ‘title insurance’ to research and cover that bad boy, so there were no competing claims or undiscovered liens.
You’ve been paying for it and paying taxes ON it, maybe for generations if it was family property.
But, sadly, if you live in the People’s Republic of the Canadian North, none of that matters.
Back in August, I posted on a little-noticed ruling out of the British Columbia Supreme Court that seemed to have sinister implications for some folks in the town of Richmond, in Vancouver, B.C.
…More collective guilt was assuaged last Thursday, when a British Columbia Supreme Court Judge decided that a group of nomadic indigenous tribes, the Cowichan, had a historic claim to some 800 acres of waterfront property in the town of Richmond, BC.
The Cowichan – yes, indigenous but nomadic – decided to file a lawsuit almost six years ago. The tribe claimed that the waterfront and island that make up the better parts of the downtown Richmond area were illegally taken from them and needed to be returned, even though the tribe was – again – nomadic and never had an established settlement in the area.
Thanks to long-established Canadian woke wussiness, a B.C. Supreme Court judge agreed with them.
…The court ruled that the titles held by the government and the other property owners were ‘legally flawed’ and invalid.
…A B.C. Supreme Court judge has recognized the Cowichan Nation’s Aboriginal title to parts of Lulu Island and the Fraser River’s south arm, concluding a five-year, 513-day trial — described as the longest in Canadian history.
The plaintiffs, including five tribes and several individuals, sought declarations of Aboriginal title over approximately 1,846 acres on Lulu Island, which now forms part of Richmond, home to B.C.’s largest airport.
“I agree that Aboriginal title is a prior and senior right to land,” Young writes in the ruling.
Still, somehow, there were people and homeowners living in the greater Richmond metropolitan area who hadn’t yet heard about this frankly insane ruling and the consequent appeal that was filed.
They’re hearing about now, though. The mayor’s been kind enough to have the city send out letters (hand-delivered, thanks to a postal strike) to every registered homeowner, alerting them.

In addition to their title issues, Mayor Malcom Brodie is also holding a meeting on the 28th of October to inform residents exactly who is in the immediate danger zone and who may be at future risk, because the Cowichans aren’t done land-grabbing. There’s been no word on the outcome of their appeal.

Brodie’s letter announced that a public information session will be held at Richmond City Hall on Oct. 28 to discuss the implications of the decision, which granted the Cowichan Nation title to large swaths of southeast Richmond and fishing rights in the Fraser River.

Brodie’s letter included a draft map outlining the areas affected by the ruling, and a second area not included in the ruling but under appeal by Cowichan First Nations.
“Hundreds of people had no idea that there was any kind of case in court, and they had no idea that people were arguing about whether Aboriginal title affected their property,” said Brodie.

Brodie said the public doesn’t have enough information about how the ruling might affect them.
There are voices calling Brodie’s preemptive action too premature. The mayor stands firm on alerting his citizens to what he sees as not only a danger to them but, if the ruling stands, to all Canadians – the complete loss of property rights to spurious claims of aboriginal title.
…“This is the biggest investment many people have in their lives,” he said. “If you are a purchaser of property, you are not going to buy one of these properties because now you have notice of Aboriginal title. You can’t say you were surprised if you buy a property expecting a fee simple title.

“It could have a very significant effect on sales,” said Brodie, who added that residents are “upset in the extreme.”

Brodie said the issue goes beyond Richmond because it sets a precedent where Aboriginal title could supersede private property rights.

“It could affect the rest of the province, and it could affect the rest of the country,” said Brodie.
There are a number of undercurrents at work here, too. First and foremost is the government’s kowtowing to so-called First Nations, as the indigenous peoples’ block is known in Canada.
There are serious rumblings concerning the latest British Columbia government attempts to move negotiations with demanding First Nations representatives over everything from parkland transfers to regulatory issues to a secret format for ‘culturally sensitive information’ instead of the now required open meetings.
The Government of British Columbia is proposing legislative changes that would allow municipal governments to hold secret closed-door meetings when discussing confidential or “culturally sensitive” information shared by First Nations — a move the provincial government says will strengthen collaboration, but which would also limit public transparency.
The proposed amendments to the Community Charter and Vancouver Charter would add new grounds for municipal governments to meet in-camera, including discussions related to Indigenous heritage, “traditional knowledge,” or government-to-government negotiations between municipalities and First Nations. This legislation would also require meetings to be closed when those negotiations involve another municipal government.
Currently, municipal governments can only close meetings for specific reasons, such as labour relations or land acquisition. Discussions involving First Nations are not among them.
Well, hang on. The First Nations claim it would protect their sacred sites from vandalism when they object to them being included in a project, etc.
People in the area have had enough of indigenous specialness as it is, and this latest, indulgent government proposal is pushing the limits of their patience.
…This latest proposal comes amid a series of high-profile and politically charged developments in the BC NDP-led government’s approach to Indigenous rights, land management, and local governance.
The proposed legislation follows the court ruling granting Aboriginal title to Cowichan Tribes to lands in southeast Richmond, and it comes in the wake of the separate ruling siding with Haida First Nation over Aboriginal title to all of the lands of the Haida Gwaii archipelago.
Both court rulings putting Aboriginal title considerations above private property rights could have immense implications nationwide.
B.C. residents can clearly see what’s happening and where their rights as Canadians rank on the pole.
…Taken together, these measures suggest a broader trend toward reducing public input in how Indigenous reconciliation policies are implemented — a shift that some might see as pragmatic for reconciliation, but others view as undemocratic and a double standard for transparency.
Another interesting undercurrent to Richmond itself is something I was completely unaware of until reading the comments under one Xweet of the mayor’s letter. There are some who believe that Mayor Brodie and the City of Richmond got out ahead of the appeal process to make sure all Richmond residents knew their property was in jeopardy because of who those residents are.
The city’s almost 210K population is 53% Asian, mostly Chinese, and only somewhere around 19% Caucasian. Richmond’s been dubbed ‘North America’s Most Asian City‘ because of it.
…Approximately half of Richmond residents identify as having Chinese ancestry with the BBC calling it “North America’s most Asian city” in 2012.[a][23] East Asian Canadians make up a majority of Richmond’s population, many of whom immigrated in the late 1980s, mostly from Hong Kong, Taiwan, and Mainland China on top of the Japanese Canadian community who immigrated to Canada nearly a century earlier. Almost three quarters of city’s population is of Continental Asian descent, where other Continental Asian Canadians communities residing in Richmond include Indo-Canadians and Filipino Canadians
There is intense speculation that the displaced Chinese in the city, many who immigrated during the Hong Kong and Tiananmen upheavals in the 80s to establish new lives, will rise up and cause serious problems for the indigenous indulgent B.C. government once they are aware that everything they’ve worked for belongs to the remnants of a wandering Indian tribe because ancestors fished on a riverbank 300 years ago.
Well this is interesting. Good on the City of Richmond, which is about half comprised of residents who are Chinese or of Chinese origin.

The David Eby referred to here is the Premier of British Columbia, who has been shamelessly advancing the First Nations’ claims over his citizens.
John Rustad has called on Premier David Eby to “immediately pause” negotiations between British Columbia and First Nations until the Supreme Court provides clarification regarding a ruling that could put private property rights in jeopardy.
The BC Conservative leader urged the premier to take things slow given that while the Cowichan decision “indicates that Aboriginal title may coexist with, and potentially supersede, fee-simple private ownership,” the court did not make it clear whether that applied to privately held land.
“That uncertainty is already having profound impacts,” Rustad wrote in a letter to Eby.
“Richmond homeowners were recently notified by their mayor that properties in the city may be subject to Aboriginal title claims. Residents are looking for clear information and reassurance.”
He accused the premier of having “dismissed these warnings,” noting that during the leaders’ debate in 2024, Eby said “nothing could be further from the truth” when asked about threats to private property.
“What British Columbians were told could never happen is now unfolding before their eyes,” Rustad continued. “Your decision to advance DRIPA without first securing constitutional clarity has created legal and social instability. Investor confidence has been shaken, and public trust is eroding. This moment requires caution, not acceleration.”
